RETURN POLICY

Products purchased at a distance can be returned according to GEO 34/2014: the consumer has the right to notify the merchant in writing that he renounces the purchase, without penalties and without citing a reason, within 14 calendar days of receiving the product or, in the case of services services, from the conclusion of the contract. The return of the products will be done at the customer's expense, within 14 calendar days from the termination of the contract. It is recommended to use the same transport service used for receiving the products

Hytech EnterpriseS.RL will refund the value of the order as soon as possible after receiving the returned product. The refunded amount and the return conditions do not include the transport costs if the delivery was made by other methods than the standard one offered by Hytech EnterpriseS.RL

Definition of the sales contract (art. 2, 5.): any contract under which the professional transfers or undertakes to transfer ownership of some products to the consumer, and the consumer pays or undertakes to pay their price, including any contract that has as its object both products and services.

Art. 12 mentions that the exercise of the right of withdrawal puts an end to the obligations of the contractual parties. The returned product must be in the same condition in which it was delivered (preferably in the original packaging with all accessories, with intact labels and accompanying documents). Products that show physical changes, bumps, chips, scratches, shocks, traces of excessive use and/or unauthorized interventions, etc., are not accepted for return.

The provisions of GEO 34/2014 apply only to the consumer defined as any natural person or group of natural persons constituted in associations as defined in art. 2 point 2 OG 21/1992 on consumer protection , republished, with subsequent amendments and additions and only in the case of distance contracts (any contract concluded between a professional and a consumer within an organized distance sales system, without the simultaneous physical presence of the professional and the consumer, with the exclusive use of one or many means of communication at a distance, up to and including the moment when the contract is concluded).

The consumer is only responsible for the reduction in the value of the products resulting from their handling, different from what is necessary to determine the nature, characteristics and functioning of the products. In accordance with Directive 2011/83/EU, point (47) of the presentation: in order to establish the nature, characteristics and functioning of the goods, the consumer should touch and inspect them in the same way as he would be allowed to do it in a store; for example, the consumer should only try on an article of clothing, not wear it.

Some products are marked with a seal applied by the manufacturer on the packaging. This seal is not necessarily present, its presence being specific to the manufacturer. The presence of the seal is not mandatory to demonstrate that the product is exactly in the form and conditions in which it was released by the manufacturer. Damage to the seal does not limit the right to withdraw from the contract.

Return procedure

Exercising the right of withdrawal

The consumer informs Hytech EnterpriseS.RL about the decision to withdraw from the contract through one of the options: model form or an unequivocal statement made on a sustainable medium (preferably e-mail: office @hytech.ro ). The consumer has 14 days from receiving the products to announce the withdrawal from the contract.

The obligations of Hytech EnterpriseS.RL

Full reimbursement of the amounts received as payment, including delivery costs (except for the situation where the consumer has explicitly chosen a different type of delivery than the standard delivery). The refund of the amounts will be made using the same reasonably applicable payment methods (in the case of cash payment on delivery, the refund will be made by transfer to the bank account provided unambiguously by the consumer). Fulfillment of the reimbursement obligation is done within 14 days of receiving the return request.

The obligations of the consumer

The products are handed over to Hytech EnterpriseS.RL personally or handed over to an authorized person (designated courier) without undue delay and within a maximum of 14 days from the announcement of the decision to withdraw from the contract. The consumer bears the return costs. The consumer is only responsible for the reduction in the value of the products resulting from their handling, different from what is necessary to determine the nature, characteristics and functioning of the products.

Excluded products, without right of return

The following categories of products can only be returned if they are sealed/ the box is unopened/ the box shows no traces inside that it has been opened:

  • a. Software licenses;
  • b. Consumables (batteries, printer cartridges, etc.);
  • c. Products that cannot be returned for health protection or hygiene reasons (personal care/hygiene products, headphones, household appliances, etc.);
  • d. Products made according to the specifications presented by the consumer or clearly customized (warranty extensions, non-standard servers);
  • e. Services (testing, assembling, mounting the component or any other service listed in the Services provided to the consumer category);

The provision of digital content that is not delivered on physical support (software applications including games delivered via a download link and activation key).

These limitations apply according to GEO 34/2014 art. 16.

 

Return of products

You can request the return of products in the following cases:

  • The delivered product does not correspond to the specifications on the website. You can request its return for replacement or a full refund of the consideration (if the product is no longer available).
  • Non-functional/damaged product within the first 48 hours from reception. If the purchased product was delivered non-functional or has manufacturing defects, it will be replaced with a functional product, following written notification or by presenting it to the office within 48 hours of receiving the product. We recommend that the verification/testing of the ordered products be done within 48 hours. Any subsequent complaint is not taken into account.
  • Product in a damaged package. For products whose parcels show visible damage upon receipt by courier, we recommend that you refuse to receive them. For evidence, the package can be photographed and a report can be drawn up together with the representative of the courier company in which the state of the package from the time of delivery is mentioned. The risk of loss or damage to the products is fully transferred to you when you take physical possession of the product. Any subsequent complaint will not be considered. If a carrier commissioned by the consumer is used, the risk is transferred when the products are delivered to the carrier.
  • Products delivered wrongly . In case a different product than the one ordered was delivered.

The return costs for the situations presented above (not in the case of canceling the purchase) are the responsibility of our store .

Return requests are notified to the e-mail address retur@hytech.ro or by presenting the respective product to the Hytech Enterprise S.RL headquarters within 48 hours of receiving the product.

Products can be returned to Hytech EnterpriseS.RL from Monday to Friday between 09:00 and 19:00.

Mention
In all the above cases, except for the one related to defects during the warranty period, the products must be returned in the condition in which they were received, accompanied by all accessories and original documents. Damage to the products or putting them in a condition that makes their resale impossible leads to the refusal of the return.

In the event that several products of the same type were purchased and the return of all is desired, the comparator has the obligation to ensure that only one has been unsealed. The return of the other products is accepted only if they are sealed. If more than one of the same kind were unsealed, we reserve the right to reduce the value of each of them by up to 20%. This reduction is done with the aim of returning it to sale as an unsealed product.
